1. Acceptance of Terms

By accessing or using the BuyGetRewards platform ("Service"), operated by Eyedealsystems LLC doing business as BuyGetRewards ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. We reserve the right to update or modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

2. Description of Service

BuyGetRewards is a product sourcing platform that connects members with purchasing opportunities. Members commit to purchasing specific products from authorized retailers, ship those products to our designated warehouse facilities, and receive cash rewards upon successful verification of received items. The Service includes access to our website, dashboard, deal listings, tracking tools, payment processing, and support systems.

3. Account Registration and Eligibility

To use our Service, you must create an account and provide accurate, complete, and current information. You must be at least 18 years of age and legally able to enter into binding contracts. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring all information provided is truthful and up to date

We reserve the right to refuse registration, suspend, or terminate accounts at our sole discretion, including for violations of these Terms or suspected fraudulent activity.

4. Use License and Restrictions

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial participation in our rewards program. You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service or its systems
• Use automated scripts, bots, or scrapers to access or interact with the Service
• Interfere with or disrupt the integrity or performance of the Service
• Impersonate any person or entity, or misrepresent your affiliation
• Create multiple accounts or transfer your account to another person
• Manipulate, falsify, or misrepresent transaction data, receipts, or shipping information
• Reproduce, distribute, or create derivative works from any part of the Service

5. Commitments and Obligations

When you commit to a deal on our platform, you agree to:

• Purchase the specified product(s) from an authorized retailer listed in the deal
• Ship all committed items to our designated warehouse within the specified timeframe
• Provide accurate tracking information for all shipments
• Ensure items are in new, unopened, and undamaged condition unless otherwise specified

Failure to fulfill commitments may result in account restrictions, reduced access to future deals, or account suspension. We reserve the right to adjust reward amounts if items do not meet the specified conditions.

6. Payments and Rewards

Rewards are credited to your account balance upon successful verification of received items. Payout requests are processed via ACH direct deposit to your verified US bank account. By providing your banking information, you authorize us to initiate electronic transfers to your account. Please note:

• Reward amounts are determined at the time of your commitment and are subject to the terms of each deal
• ACH payouts are typically processed within 3-5 business days
• A minimum balance may be required before requesting a payout
• We reserve the right to withhold payments if we suspect fraud or Terms violations
• You are solely responsible for any tax obligations arising from rewards earned

7. Disputes and Resolutions

If you believe there is an error in your account, a discrepancy in your rewards, or an issue with an order, you may file a dispute through your dashboard. We will review disputes within 2-3 business days and make a determination based on available evidence, including shipping records, warehouse verification data, and communications. Our dispute resolution decisions are made in good faith and are final.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO WARRANTIES REGARDING THE AVAILABILITY OF ANY SPECIFIC DEALS, REWARD AMOUNTS, OR THE CONTINUED OPERATION OF THE PLATFORM.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EYEDEALSYSTEMS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL REWARDS PAID TO YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Eyedealsystems LLC and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Accuracy of Materials

The materials appearing on the Service could include technical, typographical, or photographic errors. We do not warrant that any of the materials are accurate, complete, or current. We may make changes to materials contained on the Service at any time without notice. Deal availability, reward amounts, and retailer eligibility are subject to change.

12. Third-Party Links

The Service may contain links to third-party websites or services, including retailer websites where you may purchase products. These links are provided for convenience only. We have no control over the content or practices of third-party sites and assume no responsibility for them. Your interactions with third-party websites are governed by their respective terms and privacy policies.

13. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, software, and the compilation thereof, are the exclusive property of Eyedealsystems LLC and are protected by United States and international copyright, trademark, and other intellectual property laws. The BuyGetRewards name, logo, and all related marks are trademarks of Eyedealsystems LLC.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. Any earned but unpaid rewards at the time of termination will be handled in accordance with our payment policies, provided no Terms violations have occurred.

15. Modifications to Terms

We reserve the right to revise these Terms at any time. Material changes will be communicated through the Service or via email. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms. It is your responsibility to review these Terms periodically.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eyedealsystems LLC regarding your use of the Service and supersede all prior agreements, representations, and understandings.
